Sweepstakes Description. The Attune® Get Gutsy Sweepstakes (the “Sweepstakes”) is sponsored by Attune Foods, Inc. [535 Pacific Avenue, 3rd Fl, San Francisco, CA 94133], and Backroads, 801 Cedar St., Berkeley, CA 94710 (“Sponsors”) Sweepstakes is void where prohibited. By entering, each entrant accepts and agrees to be bound by these official Sweepstakes rules (the “Official Rules”).
1. To enter: Are you getting gutsy? Attune wants to know how you “listen to your gut”. Share the story of how you take charge in your everyday pursuits or life long dreams. Access www.getgutsy.com between 8:00 a.m. PT on 01/09/08 when the sweepstakes begins and 6:00 p.m. PT on 04/30/08, when the sweepstakes ends, and follow the on-screen instructions to the Sweepstakes Entry Form. When you enter please tell us in 25 words or less how you Get Gutsy! All online entries must have a valid email address. Incomplete entries will be disqualified and discarded upon receipt without further consideration and without notification to entrants. Limit one (1) entry per person and per e-mail address, regardless of whether more than one person uses the same e-mail address, for this Sweepstakes. In case of dispute as to identity of the winner who enters, entry will be declared made by the registered user (meeting eligibility criteria) of the e-mail account, and if a prize is won, it will be awarded to that registered user.
2. Prize: (1) One Grand Prize – The Grand Prize will be an active travel vacation for the Grand Prize winner and one (1) guest (“Guest”) to Alaska with Backroads. The Grand Prize is co-sponsored by Attune Foods and Backroads and will include:
One (1) Backroads Alaska trip for two persons based on a Casual Inns trip and double occupancy at an approximate retail value of no more than $2,600 per person provided by co-sponsors plus an air fare credit of up to $1,000 provided solely by Attune Foods. The total approximate retail value of the Grand Prize is up to $6,200 U.S. Dollars. The Grand Prize winner may choose from among Backroads’ available North America active trip itineraries (e.g., “Bicycling,” “Hiking/Walking,” and “Multisport”) instead of the trip to Alaska. However, trip duration shall be six (6) days or less, depending upon the trip itineraries available and the specific itinerary chosen by Grand Prize winner. All Backroads tours include: lodging (double-occupancy accommodation for Grand Prize winner and Guest); most meals; van shuttles to support guests choosing from a variety of route activity options; activity components including use of necessary gear some snacks and beverages; transportation during the tour; expert Backroads leaders and additional regional guides and experts; gratuities at hotels and restaurants; baggage transfers and porterage; comprehensive and detailed Travel Planners (documents containing information for all pre-trip, on-trip and post-trip planning; fares for transportation modes (ferries, trains, etc.) and park and other entry fees at selected attractions as outlined in the Travel Planner. Some itineraries include supplemental internal air costs. In the event that the Grand Prize winner selects an itinerary with an internal air component, Backroads will include this expense in the overall Grand Prize award as long as the overall trip value does not exceed the trip portion of the award value. Singles and Solos trips are restricted to guests who are not couples. Actual retail value may vary, depending on factors such as the specific trip itinerary selected and travel dates. Any difference between actual retail value and approximate retail value will not be awarded, but Grand Prize winner may choose to pay the difference between the approximate retail value of the Grand Prize and a more expensive trip.
The approximate retail value of airfare for both Grand Prize winner and Guest may vary. Actual retail value may vary, depending on factors such as Grand Prize winner and Guest’s point of departure and fare fluctuation. Any difference between actual retail value and approximate retail value will not be awarded.
All expenses and incidental costs not expressly specified herein as part of the Grand Prize (including, but not limited to, personal charges at lodging, meals, drinks, gratuities for trip leaders, service charges, insurance, fees, airport transfers, ground transportation, taxes, pre-trip lodging, passport and visa fees, souvenirs, local and long distance telephone calls, and other expenses) are not included and are the sole responsibility of the Grand Prize winner and Guest. Sponsors will not replace any lost, mutilated, or stolen tickets, travel vouchers, or certificates.
Grand Prize winner and Guest must complete the Grand Prize trip between June 10, 2008 and October 31, 2008. Grand Prize winner must schedule the trip within thirty (30) days of notice of winning. Grand Prize winner must coordinate with Sponsors regarding the dates that he or she wishes to travel. In the event that the Grand Prize winner is unable to travel on a Backroads scheduled trip date or fails to schedule the Grand Prize trip within thirty (30) days of notice of winning, the Grand Prize will be forfeited and Sponsors reserve the right to randomly select an alternate Grand Prize winner from among the remaining eligible entries. Grand Prize winner and Guest must travel together on the same itinerary. Once booked by Sponsors, Grand Prize winner may not change the dates of travel. Other restrictions may also apply. Sponsors are not responsible for airline or hotel cancellations or delays.
Actual retail value may vary, depending on factors such as Grand Prize winner’s choice of itinerary, travel dates, point of departure, and fare fluctuation. Any difference between actual retail value and approximate retail value will not be awarded.
The Grand Prize and Grand Prize components may not be exchanged for cash or future travel credit. No Grand Prize transfer, assignment, or substitution by Grand Prize winner or Guest is permitted. Sponsors reserve the right to substitute a prize, in which case a prize of equal or greater value will be awarded.
Limit one prize per person/e-mail address. Federal, state and local taxes are solely the responsibility of the winner. The Grand Prize winner and Guest will be required to fill-out and sign Backroads’ Release of Liability and Personal Information documentation at least 30 days before departure.
3. Winner Selection: Winners will be selected in a random drawing from all eligible entries selected on or about 05/02/08. Odds of winning depend on number of eligible entries received. Winners will be notified by e-mail and/or phone on or about 05/05/08. In the event that the Grand Prize winner fails to respond to Sponsors’ notification within fourteen (14) days, his or her prize will be forfeited and Sponsors reserve the right to randomly select an alternate Grand Prize winner from among the remaining eligible entries. By entering the Sweepstakes, entrants accept and agree to these rules and the decision of the judges, which shall be final. Winners will be required to sign and have notarized a Winner’s Agreement and Release and return it by date specified in notification or prize will be forfeited in its entirety and another winner may be selected. Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected. By submitting an entry, a winner agrees to allow use of his or her name and/or photograph for advertising this or similar promotions and agrees to write a minimum 25 word response about their Get Gutsy experience (including posting of first name, last initial, hometown city and state on the web) without additional compensation unless prohibited. All entries and all rights of ownership and publication of same will become the property of Sponsors and will not be returned. By submitting an entry, you acknowledge and agree that your entry is your original work and understand that it becomes the sole and exclusive property of Attune Foods, Inc. and acceptance of a prize constitutes permission to Attune Foods and its agencies to use the winning Attune® Get Gutsy Sweepstakes winner's name and likeness for purposes of advertising, promotion and trade without further compensation unless prohibited by law.
4. Eligibility: Sweepstakes is open to legal residents of the 50 U.S. and District of Columbia, 18 years of age or older, except employees and the families of Attune Foods, Backroads, their affiliates, subsidiaries, and promotion and advertising agencies. Attune Foods, Backroads, their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize. Subject to all federal, state and local laws. Void where prohibited or restricted by law.
5. Other Conditions: Sponsors assume no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsors reserves the right in its sole discretion to cancel or suspend this sweepstakes, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsors’ control corrupt the administration, security, fairness, integrity or proper play of the sweepstakes. Sponsors are not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the sweepstakes by a technical or human errors which may occur in the processing of the entries in the sweepstakes. Sponsors reserve the right to withdraw the transmission of this sweepstakes at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsors reserve the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web-site or to be acting in violation of the Rules.
6. Privacy: The personally identifiable information collected at this sweepstakes is collected by and will be used to administer this sweepstakes only, unless you have elected to receive additional information and promotional material from Attune Foods or Backroads. If so, your name may be added to Attune Foods, Inc. and Backroads mailing lists to receive information and promotional materials by mail or e-mail. Attune Foods, Inc. and Backroads will not share your entry information with third parties, except as necessary to administer this sweepstakes. By entering this sweepstakes or agreeing to being added to our mailing list, you agree to Attune Foods’ use of information as described herein.
7. Winners List: Prize winners will be posted at http://www.getgutsy.com and http://www.attunefoods.com/news-and-events/ on or about 05/26/08.
